The protection of your data is important to us. We would therefore like to inform you at this point which personal data we process in our association for which purpose. Updated 24.05.2018.

1. Your participation in our events

As a participant in events of our association, your personal data is stored, as far as these are necessary for the registration or participation in the events. We may also inform you that photographs, audio and/or video recordings may be taken during our events. These recordings can be used in various media (print, TV, online) and in publications (print, online) of our association.

2 Your visit to our website

The association is responsible for the content of the website and is both media owner and publisher. In the course of your visit to our website, we will collect the following information:

- the date and time of your visit to our website
- Your IP address
- Name and version of your web browser
- More information about your hardware used to access our website
- And the information you provide yourself by filling out the contact form or registering for our newsletter.

This data is processed for the following purposes:

- to make this website available to you,
- to further improve and develop this website and
- to answer your questions

If you enter personal data on this website, by entering your data you give us your consent that we may use this data electronically for the stated purpose. This data will be kept secure and will not be passed on to third parties. This does not apply to the transfer to state authorities, provided that the association is legally obliged to do so.

There is no obligation to actually provide the information we ask you to provide on our website. However, if you do not do so, you will not be able to use all the features of the Site.

2.a Ticket purchase

When purchasing tickets on elevate.at, the ticketing system of our partner ntry.at is used and integrated. User account data including first name, last name, email address and ticket purchase information will be shared with the ticketing provider ntry.at for the purpose of processing the ticket purchase. For this purpose, users must also accept the terms and conditions of ntry.at.


3. The legal basis of the processing

The legal basis for the processing of your personal data is based on your participation in our events, your visit to our website or is otherwise in our legitimate interest in accordance with the GDPR, which consists of achieving the purposes mentioned above under point 1-2.

4 Cookies

This website uses so-called cookies. A cookie is a file that can be stored on your computer as you visit a website. In principle, cookies are used to offer users additional functions on a website. For example, they may be used to help you navigate the site, allow you to continue using a site as you left it and/or save your preferences and settings when you return to the site. Cookies cannot access, read or modify any other data on your computer.

Marketing cookies are placed on our website by selected marketing partners and social media. These third party providers act as an intermediary to play our content, news and offers to you on their channels. These third-party providers also collect data via our website with their cookies in order to compile anonymised statistics on our behalf. In addition, cookies are set by social media services to enable you to share our content with your interested friends and networks. These cookies are able to track your browser usage across other websites and profile your interests. This may affect content and messages shown to you on other websites. If you do not allow these cookies, you will not be able to share content from Elevate through these third-party services.

a) Cookies from external media  

Cookies from external media collect data about user:s visits to the website, such as which pages were read or which videos were played (and to which point, if any). Playing external media content from YouTube requires your acceptance of the corresponding data processing.

You can also preset your browser so that no cookies or only certain types of cookies are stored on your computer or a message always appears before a new cookie is created. Cookies that have already been stored can also be deleted at any time via the browser settings. We would like to point out that the complete deactivation of cookies may result in you not being able to use all the functions of our online offer. You will find further information in the explanations on the individual technologies used (see below).

Legal basis
When operating technically necessary ("essential") cookies for the provision of our offer, the data processing carried out by these is necessary to protect our legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f DSGVO.

Data processing through other cookies (for statistics, marketing, external media, see below), is based on your consent given for this purpose, Art. 6 para. 1 lit. a DSGVO. You can revoke your consent at any time with effect for the future in our elevate.at/datenschutz/.

b) Cookie consent tool

We use the tool "CookieYes", with the help of which we can obtain and document the consent of our users to the use of cookies or other tracking technologies. The use of a cookie consent tool and the associated processing of personal data described above is necessary to meet legal requirements (the provision of evidence regarding your consents to the use of cookies). The legal basis is therefore Art. 6 para. 1 lit. c DSGVO.

c) Data transfer to so-called third countries

Your consent also includes consent to the processing of your personal data outside the European Economic Area (Art. 49 para. 1 lit. a DSGVO), i.e. in so-called third countries where there may not be a comparable level of data protection, such as in the USA. We would like to point out that, particularly with regard to the USA, there is a risk that the information may be processed by US authorities for monitoring purposes, possibly also without enforceability of your rights and corresponding legal remedies.

d) Analysis tools (tracking tools)

With the measures described below, which are used by us, we want to ensure a needs-oriented design and the continuous optimisation of our offer. The specific data processing purposes and data categories can be found in the information on the respective tools.

All of the following measures are carried out on the basis of your previously given consent pursuant to Art. 6 para. 1 p. 1 lit. a DSGVO. You can revoke your consent at any time with effect for the future by deactivating the respective measures at elevate.at/datenschutz/.

e) Google Analytics

This website uses Google Analytics, a web analytics service provided by Google LLC, 1600 Amphitheater Parkway, Mountainview, California 94043, USA ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. In the event that IP anonymisation is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator.

The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Irrespective of the use of the above-mentioned cookie settings, you can prevent the storage of cookies by setting your browser software accordingly; however, we would like to point out that in this case you may (also) not be able to use all functions of this website to their full extent. This website uses Google Analytics with the extension "_anonymizeIp()". This means that IP addresses are processed in abbreviated form, thus excluding the possibility of personal references. If the data collected about you is related to a person, this is immediately excluded and the personal data is deleted immediately. For the exceptional cases in which personal data is transferred to the USA, we have agreed with Google on the validity of so-called EU standard contractual clauses within the meaning of Art. 46 of the Data Protection Regulation (DSGVO) in order to offer a guarantee for compliance with the European level of data protection.

f) Facebook / Instagram

Use of Facebook Pixel, Custom Audiences and Facebook Conversion
On our website, we use the "Facebook pixel" of the social network Facebook (operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook")).

The use of the Facebook pixel makes it possible for advertisements placed by us on Facebook to be specifically played only to those Facebook users who have previously been on our website (where the pixel was placed) or to whom Facebook assigns certain characteristics (based on the data collected by Facebook about these users) that match the characteristics that we have reported to Facebook as relevant for the playout of our advertisements (so-called "Custom Audiences").

In addition, the Facebook pixel enables us to track the effectiveness of our Facebook ads for statistical and market research purposes (so-called "conversion"), as it allows us to see when a user has also come to our website after clicking on one of our Facebook ads.

If you are a Facebook member and have allowed Facebook to do so via your account's privacy settings, Facebook will also link the information collected about your visit to us to your member account and use it to target Facebook ads. For us, however, the data collected remains anonymous, i.e. we cannot draw any conclusions about the identity of visitors to our website.

Legal basis / revocation of consent
The legal basis for the processing of your personal data described above is your previously given consent pursuant to Art. 6 (1) p. 1 lit. a DSGVO. You can revoke your consent at any time with effect for the future by deactivating the respective measures in the cookie settings.

Insofar as personal data is also transferred to Facebook servers in the USA, we would like to point out that Facebook bases such data transfer on EU standard contractual clauses within the meaning of Art. 46 DSGVO in order to provide a guarantee of compliance with the European level of data protection.

Prevention of tracking (alternatives)
As a member of Facebook, you can use the following link to object to the collection of data via the Facebook pixel or to make settings regarding the types of advertisements you accept within Facebook: www.facebook.com/settings?tab=ads. The settings are platform-independent, i.e. they are applied to all computers or mobile devices.

If you are not a Facebook member, you can further opt-out of the use of cookies used for reach measurement and advertising purposes via the Network Advertising Initiative opt-out page (http://optout.networkadvertising.org/) as well as via the US website (http://www.aboutads.info/choices) or the European website (http://www.youronlinechoices.com/de/praferenzmanagement/).

g) Instagram Insights

You can also find us with an account on Instagram (https://www.instagram.com/elevate_festival/) also operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"). Facebook provides us with so-called "Insights" for this account and the content published there, such as posts or stories. These are aggregated data, i.e. statistical evaluations of the use of our account. In this way, we can obtain information about, for example, the retrieval of individual contents of our account or the interaction with them. The underlying data processing also involves the use of personal data. However, it is not possible for us to draw conclusions about specific individuals (and their behaviour on our account) from the aggregated data transmitted to us by Facebook. As the provider of our Instagram account, we do not process any personal data from your use of our service.

h) Other tools

Integration of videos via YouTube
Since local hosting of videos is not powerful enough, we also use the option of integrating videos on our website via the external third-party provider YouTube (YouTube LLC, 901 Cherry Avenue, San Bruno, CA 94066, USA, represented by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). This applies in particular to the provision of (on-demand) content that can be accessed at any time.

If you have consented to the use of cookies for external media, YouTube already receives the information that you have accessed the corresponding sub-page of our website by visiting a sub-page of our website on which a YouTube video is embedded. In addition, the data mentioned under point 2 a) of these provisions are transmitted. This takes place regardless of whether you have a user account with YouTube/Google via which you are logged in or whether you do not have a user account. If you are logged in to Google, the information about your visit to our website will be directly assigned to your Google account.

YouTube stores your data as usage profiles and uses them for the purposes of advertising, market research and/or designing its website in line with requirements. Such an evaluation is carried out in particular (also for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our website.

Please note: If you have not initially consented to the use of cookies for external media, you can still start a video playback by pressing the "OK" button on the tile preceding the video. This will then result in the data processing by YouTube/Google described above. For details of data processing, please refer to Google's privacy policy: policies.google.com/privacy. We ourselves only receive anonymised statistics from Google about the views of our videos.

We would like to point out that as a result of the use of YouTube videos, a transfer of personal data to Google servers in the USA cannot be ruled out. In such cases, we have agreed with Google on the application of so-called EU standard contractual clauses within the meaning of Art. 46 of the Data Protection Regulation in order to provide a guarantee of compliance with the European level of data protection.

i) Content and data protection with third-party providers / links to third-party providers

Elevate profiles can be found on the online platforms of some third-party providers (such as Facebook, Twitter, Instagram or Vimeo). Users of the services of these third-party providers have the option of publishing their own content there with reference to our events (in particular comments). We expressly refer to the terms of use applicable to the respective third-party providers, in particular also the corresponding data protection provisions. We are not responsible for the content published by users on these platforms and in particular do not adopt it as our own.

On our website you will also find corresponding links to our channels or profiles on the above-mentioned online platforms of third-party providers. These are not so-called social plug-ins, but simple links. Therefore, your visit to our website alone does not result in an exchange of data with the websites of these third-party providers. This is only the case if you decide to call up the corresponding service of the third-party provider by clicking on one of the symbols or links. Please refer to the data protection declarations of the respective provider for information on the processing of your personal data there.


5. Transmission of your personal data to third parties

For the secure processing of your personal data and on our website we also use programs and tools from third parties with whom we have concluded order processing agreements and thus ensured that these also guarantee the protection of your personal data in the sense of the GDPR. 9. Image rights

Each visitor consents to the use of photographic or film material or similar media taken in the course of the event for the promotion of future events. In the case of television and/or streaming transmissions as well as the production of photos, video and sound recordings by the organiser or persons commissioned by the organiser, the visitor grants the transmitting television station as well as the organiser his/her express consent that the recordings made by him/her during or in connection with the event may be exploited without compensation and without time or space restrictions by means of any current or future technical process.

As a potential data subject of a photo, you have the right to object in advance or afterwards. This means that images published by Elevate Festival must be deleted immediately following such an objection by means of the notice and take down procedure.
